《Agreement》
1. General Provisions
1.1 The ownership and operation rights of all services provided by the official mobile application software of Shanghai Bangbang Robotics Co., Ltd. (hereinafter referred to as "APP") belong to Shanghai Bangbang Robotics Co., Ltd. (hereinafter referred to as "Bangbang Robotics").
1.2 Before using the services of this APP, users should carefully read this agreement and agree to abide by all the terms and conditions herein. Once a user successfully registers, this agreement constitutes a legally binding document on both the user and the APP.
1.3 Bangbang Robotics has the right to modify the terms of this agreement. Users should pay attention to it in a timely manner when using the APP. Users agree that the APP shall not be obliged to notify. Once the modified agreement is announced, it shall effectively replace the original agreement.
1.4 Notices, announcements, statements or other similar content of the APP are part of this agreement and have corresponding legal effect.
2. Confirmation and Acceptance of Terms
2.1 This APP uses its own operating system to provide users with various services through the Internet according to the actual situation of the APP. Users must:
2.1.1 Provide equipment, including personal computers, modems and other Internet - connected devices.
2.1.2 Individually bear the communication costs incurred by personal Internet access.
2.2 Considering the importance of the services of this APP, users agree:
2.2.1 Provide timely, detailed and accurate personal information.
2.2.2 Continuously update the registration information to meet the requirements of timeliness, detail and accuracy. All originally entered information will be cited as registration information.
2.3 This APP shall not disclose the user's name, address, ID number, email address, account without permission. Unless:
2.3.1 Bangbang Robotics needs it according to the APP and/or trial service requirements.
2.3.2 The user requests and/or authorizes this APP to disclose such information.
2.3.3 The user independently publishes and/or discloses such information on this APP and other public media.
2.3.4 The corresponding laws, regulations and procedural service requirements require this APP to provide the user's personal information.
2.4 If the information provided by the user is inaccurate, untrue, illegal or invalid, this APP reserves the right to terminate the user's use of all services of this APP. While enjoying the various services of this APP, the user agrees to accept various information services provided by this APP.
2.5 Some of the network services provided by this APP are paid services. Users need to pay the corresponding fees to this APP for using paid services. For paid services, this APP will give users clear prompts before they use them. Only when users confirm that they are willing to pay the relevant fees according to the prompts can they use such paid network services. If the user refuses to pay the relevant fees, this APP has the right not to provide such paid services to the user.
2.6 The user agrees that the APP has the right to send relevant information such as APP, trial messages, activities, etc. to the user in the form of emails, text messages, phone calls, etc.
3. User Account
3.1 Users can register as official users through the methods specified by the APP. Becoming an official user means obtaining the corresponding rights and permissions as specified by this APP; those who are not authenticated only enjoy some of the user rights and permissions specified by this APP. The APP has the right to change the design of user rights and permissions.
3.2 The ownership of the user account belongs to this APP, and the user only enjoys the right to use it. The APP reserves the right to recover user accounts that have not been used for 6 months.
3.3 The user is obliged to ensure the security of the password and account. The user shall bear all responsibilities for any losses or damages caused by all activities carried out using the password and account, and this APP shall not bear any responsibility.
3.4 The user shall not lend the account registered on this APP to others for use. Otherwise, the user shall bear all responsibilities arising therefrom and be jointly and severally liable with the actual user.
3.5 If the user discovers that the account has been used without authorization or any other security issues occur, the user should immediately change the account password and keep it properly. If necessary, please notify this APP. The APP shall not bear any responsibility for the illegal use of the account due to hacker attacks or the user's negligence in custody.
4. User Responsibilities
4.1 When using this APP in any way, users should abide by the laws and regulations of the People's Republic of China and the provisions of these terms and conditions. Including but not limited to:
4.1.1 Publishing any content that violates the laws and regulations of the People's Republic of China, including but not limited to:
4.1.1.1 Content that opposes the basic principles established by the Constitution.
4.1.1.2 Content that endangers national security, discloses state secrets, subverts state power, and undermines national unity.
4.1.1.3 Content that damages national honor and interests.
4.1.1.4 Content that incites ethnic hatred, ethnic discrimination, and undermines ethnic unity.
4.1.1.5 Content that undermines national religious policies, promotes cults and feudal superstitions.
4.1.1.6 Content that damages the reputation of state organs.
4.1.1.7 Content that spreads rumors, disturbs social order, and undermines social stability.
4.1.1.8 Content that spreads obscenity, pornography, gambling, violence, homicide, terror, or instigates crime.
4.1.1.9 Content that insults or slurs others.
4.1.1.10 Content that infringes upon the legitimate rights and interests of others.
4.1.1.11 Content that contains other content prohibited by laws and administrative regulations.
4.1.2 Publishing any content that hinders public order and security, is false, fraudulent, threatening, coercive, or causes public disgust.
4.1.3 Publishing any content that discriminates based on belief, gender, sexual orientation, clan, age, or disability.
4.1.4 Publishing content that contains the privacy information or personal information of others without their consent.
4.1.5 Publishing advertisements for any illegal services, or using any content or information obtained through this APP or from using this APP to send any advertising information, promotional materials, spam through speech, publication, posting, uploading, email, text message, instant messaging, or other means.
4.1.6 Publishing any content that infringes upon the patent rights, trademark rights, copyrights, trade secrets, and other intellectual property rights or proprietary rights of others, or any content that the user has no right to publish according to relevant laws, regulations, and agreements.
4.1.7 Uploading, spreading, providing any software virus, or any other method, device, computer code, document, or program material that damages any computer software, hardware, communication equipment, or is specifically used to deliberately bypass or damage the technical protection measures of the APP or others' copyright.
4.2 This APP has the right to remove the content published by the user at any time for any reason, freeze, delete or cancel your account, and the APP has the right to terminate the user's use of this APP at any time for violations of these terms and conditions or other reasons.
4.3 For user content uploaded, spread, published, posted, or transmitted in the form of instant messages, emails, or any other means through this APP or during the use of this APP, the user must declare and guarantee:
(1) The user has the right or has obtained authorization and consent to carry out such actions;
(2) Such content is true, accurate, complete, and complies with the provisions of these terms and conditions;
(3) The user's use of the provided content will not cause any harm to the APP, the organizing committee, its affiliated parties, partners, or any other individual or entity. In case of any disputes, lawsuits, and claims (including reasonable attorney fees and court costs) filed by any third party due to violations of any warranties and statements stipulated in these terms and conditions, the user shall bear the relevant legal responsibilities and make compensations on its own, and ensure that the APP, the organizing committee, its affiliated parties, partners, service providers, and all the above - mentioned staff are exempt from such disputes, lawsuits, and claims.
4.4 Without the written permission of the APP, the user shall not transfer any rights enjoyed or obligations assumed under these terms and conditions.
5. Service Risks and Exemption of Liability
5.1 This APP does not guarantee that the services will necessarily meet the user's usage requirements, nor does it guarantee that the services will not be interrupted, and will be timely, safe, and error - free.
5.2 All activities carried out by the user using the APP are the responsibility of the user, and the APP shall not bear any direct or indirect liability arising therefrom.
5.3 This APP refuses to provide any guarantee, including whether information can be transmitted accurately, timely, and smoothly. The user understands and accepts that any information and materials downloaded or obtained through the services of this APP depend on the user, and the user shall bear any risks such as system damage, data loss, and others.
5.4 The APP and/or the organizing committee shall not be liable for any direct, indirect, incidental, special, or consequential damages.
6. Limitations on the Trial Use of Bangbang Vehicle
6.1 Suitable Populations
6.1.1 Populations who are unable to walk or sit - stand independently due to various reasons and those with progressive muscular dystrophy (with upper limb and hand function above level 4), including neurological diseases such as nerve paralysis (stroke, brain injury, spinal cord injury, polio, cerebral palsy, etc.);
6.1.2 Severely weakened elderly people (with upper limb and hand function above level 4), those who cannot complete independent walking, sitting, and standing;
6.1.3 Critically ill populations whose conditions are stable and who need short - distance transfer.
6.2 Contraindications
6.2.1 Populations with unstable clinical conditions and those with orthostatic hypotension are prohibited from using;
6.2.2 Populations with unhealed fractures and dislocations, those with severe joint deformities, those with scoliosis (unsuitable for standing), those with severe osteoporosis (T < - 2.0), and those with a leg length difference of more than 2 cm are prohibited from using;
6.2.3 Populations with insufficient upper limb mobility should use it with caution;
6.2.4 Populations with mental and cognitive impairments and other clinical conditions that can lead to instrument operation risks during the walking process (including those with visual and hearing impairments, pain, etc.) are prohibited from using;
Note: Before trying the Bangbang vehicle, be sure to consult a doctor for consent and follow the doctor's advice. Otherwise, Bangbang Robotics will not bear any risks.
7. Ownership of APP Content
The content defined by the APP includes but is not limited to: text, software, sound, photos, videos, charts; all content in advertisements; all content of emails; and business information provided by the APP to users. All such content is protected by intellectual property and other property ownership laws. Therefore, users can only use this content under the authorization of the APP and/or the organizing committee, and shall not copy, tamper with this content without permission, or create derivative products related to the content.
8. Supplementary Provisions
8.1 The conclusion, execution, interpretation, and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China.
8.2 If any provision of this agreement is wholly or partially invalid or unenforceable for any reason, the remaining provisions of this agreement shall still be valid and binding.
8.3 The right to interpret and revise this agreement belongs to the APP and/or Bangbang Robotics.
